Removal of Conditions

After marrying a U.S. citizen or a legal permanent resident, if an applicant receives a green card that is approved during the marriage phase of less than two years, the applicant’s residency is considered as ‘conditional.’ The issued ‘conditional green card’ is valid for two years. The couple must file the Form I-751, Petition To Remove Conditions on Residence, with USCIS 90 days prior to the green card expiry.

Frequently Asked Questions

  • What is the right time to file for Removal of Conditions?
The right time to file Form I-751, Petition To Removal of Conditions is during the 90-day window before the expiry of the conditional green card.
  • What proofs are required with Form I-751?
The evidence required to prove your marriage is genuine and continuing is joint property documents, joint bank statements, joint tax returns, children’s birth certificates, bills showing both names, and affidavits from people who know your relationship.
  • What are the consequences of not filing the joint petition within the required 90-day window?
The USCIS completely rejects the petition if the couple files too early for Removal of Conditions. The delayed petition filing results in the termination of the permanent residency and places the applicant in the removal process.

  • Can a spouse apply for removal of conditions in case of divorce or separation?
